Other issues, especially taxes, no doubt ranked high in the minds of Westchester County voters, who last night in a stunning upset threw out incumbent county executive Andy Spano in favor of Republican challenger Rob Astorino by an impressive 58–42 margin. But it didn’t help that county residents felt strong-armed by the federal government and private litigants into a controversial lawsuit settlement on low-income housing that cuts deeply into the county’s tradition of suburban home rule on development issues—or that Spano reacted to voter discontent by suggesting that critics of his housing plans were racist.

Announced in August, the settlement calls for the county over seven years to override local zoning and other rules to force the construction of at least 750 low-income housing units, most to be located in relatively affluent towns. The intention is to increase the number of poorer minorities living in these areas. A federal judge had sided with plaintiffs’ complaints that the county had accepted federal funds but had not lived up to its talk of combating purported “segregation” based on income. (Affluent blacks and other minorities have long been welcome in many of the communities under scrutiny; as the Manhattan Institute’s Howard Husock points out, blacks are at most slightly underrepresented in towns like Scarsdale, Harrison, and Pound Ridge compared with their overall presence in the affluent income brackets typical of those towns.) The Obama administration took credit for arm-twisting the county into going along: “This is historic, because we are going to hold people’s feet to the fire,” said HUD deputy secretary Ron Sims, who added: “It’s time to remove zip codes as a factor in the quality of life in America.”

Read that last line again: it’s pretty startling. To remove zip codes “as a factor in the quality of life” in a nation—so that 10455 (South Bronx), 91731 (El Monte, California), and 48210 (Detroit’s west side) have exactly the same implications for quality of life as 10021 (New York’s Upper East Side), 90210 (Beverly Hills), and 48009 (Birmingham, Michigan)—would require extreme, indeed utopian, ventures into social engineering. It’s certainly a result unachieved by Scandinavian social democracy (in which cities like Stockholm and Copenhagen include both chic, desirable neighborhoods and neighborhoods that are neither), or for that matter by the harder tyrannies of the Left. Even 50 years after Castro’s seizure of power in Cuba, Wikipedia describes the Miramar neighborhood as “an upscale district . . . one of the better parts of Havana.”

What kind of social engineering might be called for to remove zip code as a quality-of-life factor differentiating gritty Yonkers from leafy Yorktown, or crime-plagued Mount Vernon from calm Mamaroneck? The New York Times lays it out:

. . . the county admitted that it has the authority to challenge zoning rules in villages and towns that in many cases implicitly discourage affordable housing by setting minimum lot sizes, discouraging higher-density developments or appropriating vacant property for other purposes. Westchester agreed to “take legal action to compel compliance if municipalities hinder or impede the county” in complying with the agreement.

Not surprisingly, voters across Westchester reacted with alarm as to what this would mean. Aside from the abridgment of home rule, a requirement to accept dense development would probably bring new costs (the introduction of water and sewer systems, school expansion), which would be unlikely to be offset by property tax collections on the new developments. Planning to use a vacant parcel for new softball fields, or preserve it as open space? Sorry, but using town property for purposes that town residents favor could put the supervisors in violation of the settlement. And while much was said about how it would make sense to provide housing options for teachers, cops, and other town workers, along with downsizing retirees and others with local ties, the fact is that towns enter a legal minefield when they attempt to earmark low-income housing for those constituent groups. “Fair housing” litigants have repeatedly sued and sometimes won on the theory that such policies are unfair to other poorer people who might want to give the suburbs a try. And indeed, the settlement “requires the county to market the homes aggressively to black and Hispanic residents of the New York City area”—not just those already working or living in the county.

One question in many voters’ minds was whether incumbent county executive Spano, a Democrat, had in fact fought hard against going along, or had caved too readily to what both sides agreed were unprecedented demands (including $10 million for the plaintiffs and their lawyers). After all, the deal offered Spano certain political advantages, including relatively favorable press in both the New York Times and Gannett’s reliably liberal local Journal News, both of which predictably applauded the settlement on their editorial pages. Spano insisted that the county was yielding against its will. At the same time, he used the quiet weeks leading up to Labor Day to steamroll the plan through a compliant board of county legislators. Challenger Rob Astorino called for a slowdown to examine whether the county had really exhausted its options. Spano replied by playing the race card: he said continued delay in approving the settlement would “make us a symbol of racism.”

As it happens, a lot of Westchesterites—residents of a county known for racial liberalism from way back, and which voted for Barack Obama by a comfortable margin—don’t like being talked to that way. Now Spano, despite a well-financed campaign whose online ads were nearly as ubiquitous as Michael Bloomberg’s, and all the advantages of incumbency and union backing, is packing for his departure. Astorino, just recently written off as a long shot, will be moving into his office. And officials of other local governments have a new reason to fight, not just go along meekly, when the social engineers and lawyers come knocking at their door.

Keep It Dry ::: Americans Buy Enough Ammunition In 12 Months To Equal Two Boxes For Everyone In The USA

Change we can believe in.

A record setting 12 billion rounds of ammunition have been bought by Americans in the last 12 month That's up two to five billion over a normal year.

With a U.S. population estimated at 305 million at the beginning of 2009, the ammo sales in the last year amount to almost two 20 round boxes for every man, woman, and child in America.

Many anti gun groups are calling ammunition purchases and shortages "Paranoid."
But, there are a lot of reasons why ammunition sales are high. Some are economic reasons, and some are government related. In addition to two wars going on, there's target shooting, hunting, and Law Enforcement use where department's orders have increased 40% this year. And, yes, even some people who are stock piling ammo.

The U.S. Government has a lock on priority as first in line for ammunition purchases. All ammunition government contractors must provide for the military first. With two wars going on, that calls for lots of government purchased .308, .223, and 9mm.

Ammo sales have been good for commercial manufacturer's bottom lines. In addition to sales to the public, commercial manufacturer have government ammo contracts that take ammo out of the commercial market. Winchester reported a 2009 3rd quarter profit of $23 million, up from $9.8 million in 2008.

Commercial manufacturers are running 24/7 to try to keep up. Many people have been added to the payroll. These are verifiable jobs "saved" or "created" by Obama. Americans should give him credit for job growth here. David Axelrod would be proud.

How Conveeenient ::: Mexican mayor announces death of rival... hours before body was found

They are just out of their minds down there.

A Mexican mayor has sparked fury by announcing the death of his main political rival - hours before the body was found and two days before it was identified.

Speculation has arisen that Mauricio Fernandez may have had something to do with the killing after he made the slip while being sworn in as mayor of San Pedro Garza Garcia, one of Mexico's most exclusive areas.

Speaking during his re-election ceremony, he announced: 'Black Saldana, who apparently is the one who was asking for my head, was found dead today in Mexico City.'

The problem was that the barefoot, blindfolded corpse of 'Black Saldana', whose real first name is Hector, was not found for another four hours, according to Mexico City prosecutors. His body was also not identified for another two days.

When questioned about whether he knew anything about his opponent's death, Mr Fernandez said: 'Sometimes there are coincidences in life. It's better to look at it this way.'

Dem Pollster: FOX News "most professional network of any I have dealt with"

And the quote just gets better...

Estrich encouraged Democratic pollster Doug Schoen to join Fox Nation at the end of the 2004 election. Weary of the unpredictability of other networks’ schedules, he was happy to sign on — and says he’s encouraged his Democratic friends to do the same.

“They are the most professional network of any I have dealt with,” he said. “If you are a Democrat who wants to deliver mindless talking points on Fox, it’s probably best to go to MSBNC and hope you get a chance to recite them. I think Fox encourages critical views of all sides, asks different kinds of questions and wants to have diversity of view.”

Beckel believes Fox viewers are more open to the Democratic side of the story than stereotypes might suggest. And indeed, a 2008 Pew Research survey found that while almost half of viewers who regularly watch Fox News identify as Republican or Republican leaning, 39 percent tip Democratic and 12 percent have no stated angle at all.

Take that, Bambi.

Terrorists... The Other White Meat ::: Two armed militants mauled to death by bear after setting up hideout in its den

Can you make this stuff up?

Two armed Muslim insurgents picked the wrong cave to hide out in after they were both killed by a bear.

The men were carrying AK-47 assault rifles as they sought refuge in Indian administered Kashmir, but were taken by surprise by the giant carnivore.

Two other militants were also injured by the Himalayan black bear, but managed to escape and make their way to a village near Srinagar.

The attack is thought to be the first such incident since Muslim separatists launched its campaign against Indian rule in 1989.

Police even found the remains of pudding the men had prepared before the bear attacked the group.

Farooq Ahmed, a police officer, said the militants had made their hideout in the bear's den.

The two dead, members of Hizbul Mujahedin, have been identified as Mohammad Amin - known as Qaiser - and district commander Bashir Ahmed, alias Saifullah.

Colonel Brar, Srinagar defence spokesman, said: 'Both bodies were mauled badly by some wild animal, and apparently by a bear, as the area is inhabited by Himalayan black bear.

'The attack seems to have been so violent that both the militants got no chance to fire back at the wild animal.'

Ich Bin Ein Sorry Excuse For A US President ::: Behind Obama's Berlin Wall Snub

This "snub" has been what has put my dislike and distrust of Obama irretrievably over the top.

He could go to Germany to celebrate himself, but not the liberation of millions.

Prior to this, calling him a commie-rat-bastard might have seemed hyperbolic, now it is simply an astute observation.

In his first year in office, Barack Obama has visited more foreign countries than any other president. He's touched ground in 16 countries, easily outpacing Bill Clinton (three) and George W. Bush (eleven). It's an itinerary befitting a "citizen of the world."

But there's one stop Obama won't make. He has begged off going to Berlin next week to attend ceremonies commemorating the fall of the Berlin Wall. His schedule is reportedly too crowded. John F. Kennedy famously told Berliners, "Ich bin ein Berliner." On the 20th anniversary of the last century's most stirring triumph of freedom, Obama is telling them, "Ich bin beschäftigt" - i.e., I'm busy.

It doesn't have quite the same ring, does it? Obama's failure to go to Berlin is the most telling nonevent of his presidency. It's hard to imagine any other American president eschewing the occasion. Only Obama - with his dismissive view of the Cold War as a relic distorting our thinking and his attenuated commitment to America's exceptional role in the world - would spurn German president Angela Merkel's invitation to attend.

Obama famously made a speech in Berlin during last year's campaign, but at an event devoted to celebrating himself as the apotheosis of world hopefulness. He said of 1989, "a wall came down, a continent came together, and history proved that there is no challenge too great for a world that stands as one."

The line was typical Obama verbal soufflé, soaring but vulnerable to collapse upon the slightest jostling from logic or historical fact. The wall came down only after the free world resolutely stood against the Communist bloc. Rather than a warm-and-fuzzy exercise in global understanding, the Cold War was another iteration of the 20th century's long war between totalitarianism and Western liberalism. The West prevailed on the back of American strength.

But Obama doesn't think in such antiquated, triumphalist terms. Given to apologizing for his nation abroad, he resolutely downplays American leadership. "President Obama is applying the same tools to international diplomacy that he used as a community organizer on Chicago's South Side," the Washington Post notes, approaching "the world as a community of nations, more alike than different in outlook and interest." To the extent that the Cold War doesn't fit this unbelievably naïve worldview, it's an intellectual inconvenience.

Wouldn't Obama at least want to take the occasion to celebrate freedom and human rights - those most cherished liberal values? Not necessarily. He has mostly jettisoned them as foreign-policy goals in favor of a misbegotten realism that soft-pedals the crimes of nasty regimes around the world. During the Cold War, we undermined our enemies by shining a bright light on their repression. In Berlin, JFK called out the Communists on their "offense against humanity." Obama would utter such a phrase only with the greatest trepidation, lest it undermine a future opportunity for dialogue.

Pres. Ronald Reagan realized we could meet with the Soviets without conceding the legitimacy of their system. He always spoke up for the dissidents - even when it irked his negotiating partner, Mikhail Gorbachev. Whatever the hardheaded imperatives of geopolitics, we'd remain a beacon of liberty in the world.

Obama has relegated this aspirational aspect of American power to the back seat. For him, we are less an exceptional power than one among many, seeking deals with our peers in Beijing and Moscow. Why would Obama want to celebrate the refuseniks of the Eastern Bloc, when he won't even meet with the Dalai Lama in advance of his trip to China?

Gibbs Doesn’t Know if WH Reviewed Constitutionality of Forcing Us to Buy Health Insurance

The Constitution... a document to be used by Democrats only if it can stop a Republican.

(CNSNews.com) - White House Spokesman Robert Gibbs said today that he does not know if White House lawyers have reviewed whether it is constitutional for the federal government to order individuals to buy health insurance and said that the White House is not seriously considering the concerns of people such as Sen. Orrin Hatch (R.-Utah) who believe the mandate is not constitutionally justified.

This was the second time in two weeks that Gibbs had dismissed concerns that the Constitution does not give the federal government the power to force individuals to purchase items the government wants them to purchase.

Hatch told CNSNews.com last week that forcing people to buy health insurance cannot be justified under the Constitution’s Commerce Clause.



“But here would be the first time where our government would demand that people buy something that they may or may not want,” Hatch told CNSNews.com. “And, you know, if that’s the case, then we didn’t need a ‘Cash for Clunkers,’ all we had to do is have the federal government say you all got to buy new cars, no matter how tough it is on you. You know, they could require you to buy anything. And that isn’t America. That’s not freedom. That’s not constitutionally sound. Now, there may be some gimmicky way that they can do this, but I can’t think of a gimmicky way that would be constitutionally justified.”

Gibbs was asked by a reporter on Monday: “Have White House lawyers looked at this issue? Has this been examined in any way?”

Gibbs responded: “Not that I know of. I don’t think it has gotten to the point where anybody questions the legitimacy of it.”

The reporter followed up: “Well, Orrin Hatch questions the legitimacy of it.” Gibbs quipped, “Well, you should ask him.”

The reporter asked, “Do you not feel there is any concern at all about whether it is constitutional for Congress to impose a mandate?”

“No,” Gibbs said.

The ordeal began when the unidentified woman saw a group of men allegedly breaking into cars at her apartment complex on Pinemont in northwest Houston late Monday night.

When the group moved on to her car, the woman, who is eight-months pregnant, said she fired a shotgun from her balcony. One of the men died, say police.

The others fled the scene in a black truck.

The Insanity of Leftism As Captured In a Single Ridiculous Resolution

I tried to cover this doc during last week's show and wasn't able to give it the sunshine it richly and truly deserves.

The city council of Richmond, CA -- now famous for the terrible high school gang rape of two weeks ago -- apparently decided that having a drivers license checkpoint by same said high school was a terrible thing that needed to be stopped. And thus they came up with this wonderful resolution to get law enforcement to stand down.

Hopefully I'll still manage to a do a "Read Between The Lines" of it this week. But, either way, enjoy. It is wonderfully insane.

Who's Shocked? ::: Pelosi Plan Makes Millions of People Pay Fines

Just like the tobacco funding of CHIP requires 10s of millions new smokers...

Speaker of the House Nancy Pelosi’s healthcare plan presumes that about 8-14 million American workers will pay fines rather than buy health insurance. Unless they do, there’s a $167-billion hole in her financing plan and everything falls apart.

Like the rest of us, this group would face higher-than-ever insurance prices under Pelosi’s proposed bill.

Speaker Pelosi, President Obama, and others claim they will make coverage cheaper, yet the official projection relies upon millions who would prefer to pay fines rather than join their system. In some cases the individuals would pay the penalty; in others their employers would pay; and sometimes both.

The estimate of 8-14 million who would be fined is based on the official projections made by the Congressional Budget Office (CBO).

The plan is built around a major contradiction. Only if it fails to make insurance more affordable would the bill generate the promised $167-billion by fining people who would still remain uninsured.

Why would this happen? Because insurance would become more expensive if the legislation passes, thus increasing the disincentives to buy coverage.

Premiums under the new government-run “public option” will probably be higher than from private insurance, according to the CBO (page 6 of its report). The Associated Press reports that “premiums in the public plan would be higher than the average for private plans.” Rather than inducing private carriers to lower their premiums, other experts agree that private insurance will also be costlier under Pelosi’s plan, as insurers pass along the bill’s tax increases.

Yet Speaker Pelosi claims the measure will bring “lower costs for every patient” by “lowering healthcare costs for all of us.” President Obama campaigned on a promise that the plan would save families $2,500 a year in lower premiums. He doesn’t mention that figure anymore.

The exact number of those who will pay fines is unknown, but it is huge. Here’s how the projection of 8-14 million was calculated, based on the CBO report...
